Job description

The Contract & Commercial Manager is responsible for managing all contractual and commercial aspects of BW Water’s EPC wastewater treatment project for Tata Electronics. The role ensures contractual compliance, cost control, risk mitigation, and protection of BW Water’s commercial interests from tender award through project completion and final account closure.

Job requirements

• Bachelor's degree in Quantity Surveying, Engineering, Law, Business, or related field
• 812+ years' experience in contract and commercial management for EPC projects
• Proven experience in industrial or semiconductor wastewater treatment projects
• Strong knowledge of EPC / FIDIC / bespoke contracts
• Experience working with multinational clients and high-compliance environments

Job responsibilities

Contract Management

• Administer the EPC contract with Tata Electronics, ensuring strict compliance with contractual terms, scope, performance guarantees, and milestones
• Manage contractual correspondence, notices, variations, change orders, and extensions of time (EOT)
• Ensure timely submission of contractual notifications in accordance with contract conditions
• Maintain complete and auditable contract records and registers

Commercial & Financial Management

• Manage project budgets, cost tracking, forecasting, and cash flow in line with BW Water financial controls
• Review, certify, and submit progress claims, milestone payments, variations, and final accounts
• Monitor payment timelines and coordinate with finance to ensure timely collections
• Identify cost risks and opportunities to optimize project margins

Claims, Risk & Dispute Management

• Prepare and evaluate claims related to scope changes, delays, regulatory changes, or performance impacts
• Assess entitlement and quantum for claims and counterclaims
• Lead commercial negotiations with Tata Electronics, subcontractors, and suppliers
• Support dispute avoidance and resolution, working with legal advisors when required

EPC & Semiconductor-Specific Support

• Support project teams on contractual implications related to process performance guarantees, water quality specifications, uptime requirements, and liquidated damages
• Review subcontract and vendor contracts to ensure flow-down of EPC obligations
• Ensure alignment between technical scope, procurement strategy, construction activities, and commercial commitments

Stakeholder & Reporting

• Act as the primary commercial interface between BW Water, Tata Electronics, consultants, and subcontractors
• Provide regular commercial reports to BW Water senior management
• Support internal and external audits, governance reviews, and compliance requirements
