Position Description:
- Responsible for providing representation, analysis and counsel on complex legal and policy matters. Responsible for providing legal services involved in the preparation, review and negotiation of contracts as appropriate. Provides litigation management and analysis, including claims analysis, as appropriate. Provides advice to company personnel regarding strategic issues and provides primary support for the Vice President Legal Services and Corporate Secretary in job tasks below. Assignments are generally performed with minimal direction. Relies on extensive knowledge, experience and judgment to plan and accomplish goals. Leads and directs the work of others.
Essential Job Tasks:
- Assists in monitoring, analyzing, and interpreting proposed and final federal and state regulatory changes affecting utility operations, including but not limited to the Clean Air Act, Clean Water Act, RCRA, and the Safe Drinking Water Act.
- Reviews and assists in preparing comments to proposed rules, ensuring the organization’s technical and legal positions were accurately represented and strategically aligned.
- Provides day-to-day legal interpretation for complex or ambiguous environmental compliance questions, ensuring consistent and defensible regulatory positions.
- Supports negotiations with regulators by clarifying statutory and regulatory intent, identifying defensible compliance pathways, and mitigating enforcement risk.
- Advises on Notices of Alleged Violations (NOAVs), Consent Orders/Decrees, and potential fines, including strategy development and response preparation.
- Reviews and provides legal comments on construction and operating permits, including air, water, and waste permits issued by SCDHEC and other agencies.
- Supports or coordinates litigation strategy for environmental matters, including administrative appeals, permit challenges, enforcement actions, or citizen suits.
- Provides legal interpretation and compliance guidance for FERC hydroelectric licenses, including Fish and Wildlife Service Agreements (FSA), Biological Opinions (Bi Ops), and associated environmental conditions.
- Supports permitting, contract development, and stakeholder negotiations related to hydro operations, water management, and habitat protection.
Position Requirements:
- Juris Doctor Degree + 6 years of progressively responsible experience in the areas of environmental law and compliance.
- Must be a member of South Carolina Bar.
Compensation Information:
$180,260 - $225,310 (min. - mid.)
